By accessing or using the ChalkDoc website, you agree to these terms of use.
Using and sharing ChalkDoc
- You may use ChalkDoc to access and create educational materials (“materials”). Some of these materials are free to use, while others require payment to use. You may only use ChalkDoc for non-commercial purposes.
- We grant you a license to use these materials under CC BY-NC 4.0. For us, this means that you can freely share and modify everything you produce from ChalkDoc, so long as you never do so for commercial purposes and you credit ChalkDoc if you share it beyond your own classroom. If you share these materials beyond your classroom (e.g. among other teachers, on a blog, etc.) you must attribute us as “ChalkDoc” or “ChalkDoc SPC.” There is one exception to this CC BY-NC 4.0 license, described below.
- There is one exception to the CC BY-NC 4.0 license. Geometric figures, such as shapes, lines, and segments, are attributable to Sketchometry. By request of Sketchometry, these geometric figures (not the question or the materials as a whole) are available under a CC BY-ND 4.0 license.
- While you can share materials from ChalkDoc, you may not share your account with anyone else for any reason.
- You have the right to terminate your account at any time. Even if you stop using ChalkDoc, you may continue using ChalkDoc materials forever.
Account options
- If you have no ChalkDoc account, you are considered a guest. You can learn a lot about ChalkDoc as a guest, but will not have the power to create or save materials.
- If you have an unpaid account, you will have the power to access, customize, and save lots of materials for free.
- If you upgrade to a paid account, you will have the power to access, customize, and save all materials for a year. If you ever choose not to pay for an additional year, you will keep your account but lose access to paid materials. However, you will still have access to everything you already created with your paid account.
Who you are
- You will keep your personal information accurate and up-to-date. Among other things, this means your e-mail address needs to be real and one you still check. It also means any information you share about your teaching placement is and remains true.
- You will only use your own account. Accounts are free and we work hard to make sure access to all content is very inexpensive. If you’re concerned about your ability to pay, please reach out to us so we can help.
- You will not use ChalkDoc if you are under 13.
Privacy
- We will never sell or distribute the personal information you used to make or maintain your account (your “personal information”) to any person or organization outside of ChalkDoc SPC, unless necessary to enforce this agreement or otherwise resolve a legal claim.
- Just like you, we can share the materials you create on ChalkDoc.
- We will monitor your usage data so we can measure and improve the work we do.
- We process credit cards through a third-party (e.g. Stripe). By entering credit card information on ChalkDoc, you give us permission to share your credit card information with that third-party and you agree to that third-party’s terms of service and privacy policy. We do not store your credit card information on ChalkDoc.
- When you cancel your account, your data remains on ChalkDoc. If you would like your personal information permanently deleted, get in touch with us at itsoverforreal@chalkdoc.com and we’ll take care of it.
- If you have great things to say about us, we’d love to hear them and—if they’re really great—to share them. If we do, we will not use your personal information to credit you without your express permission.
Playing nicely with others
- You will not use ChalkDoc in a way that violates any law, such as by infringing on or violating someone’s rights, or otherwise harasses, threatens, or discriminates against anyone.
- You will never collect or tamper with any information or materials on ChalkDoc using automated means, such as harvesting bots, robots, spiders, or scrapers.
- You will not compromise the security, appearance, or functionality of ChalkDoc, such as by uploading malicious code, altering the source code, or coordinating a denial of service attack.
- You will never collect or tamper with users’ personal information.
Keeping ChalkDoc safe and healthy
- We can remove or modify anything you create on ChalkDoc if we believe it violates the terms of use.
- We can modify or disable your account for any reason and at any time. If we disable your account, you will not create another one without our express permission.
- We may disable access to the website to protect our users or improve the website.
Definitions and clarifications
- The “the website” or “the ChalkDoc website” refers to ChalkDoc.com and all its subdomains.
- Reference to “ChalkDoc” means the website, the services it offers, and the materials it contains. Reference to “ChalkDoc SPC” means the organization ChalkDoc SPC (at times referred to as “we,” “us,” and “our”).
- Users include anyone who accesses ChalkDoc.
General terms
- The website and all material contained on the website is owned by ChalkDoc SPC. This includes all material created by you and other ChalkDoc users.
- We reserve the right to change what ChalkDoc offers and how it operates at any time.
- ChalkDoc is available to you on an “as is” and “with all faults” basis. We will always try to keep the site helpful, safe, and easy-to-use, but we cannot promise it will be.
- ChalkDoc may link or refer to other websites or services. We do not endorse, nor can we control, such websites. Access and use of such websites is at your own risk.
- You agree to indemnify and hold harmless ChalkDoc SPC from and against all claims and expenses, including attorney’s fees, arising out of the use of ChalkDoc or any derivatives of its materials.
- To the fullest extent permitted by law, you agree not to hold ChalkDoc SPC liable or otherwise responsible for any damages resulting from the use of or inability to use ChalkDoc or any derivatives of its materials.
- If you have a concern with us, we want to hear from you. We’re reasonable and feel we can resolve just about any issue amicably. That said, if we’re unable to address your concern, you agree to resolve any claim, cause of action, or dispute (“claim”) you have with us arising from or relating to these terms of use in state or federal courts in and for King County, Washington. The laws of the State of Washington will govern these terms of use as well as any other claim that might arise between you and us.
- If any part of these terms of use is unenforceable, the rest will remain in full force and effect.
- The terms of use represent the entire agreement between you and us and supersedes any prior agreements.
- We reserve the right to amend these terms of use at our discretion at any time. Your continued use of ChalkDoc represents your acceptance of these terms of use.
- You consent to having your personal data transferred to and processed in the United States.
